NOTICE OF PASSING OF ZONING BY-LAW AMENDMENT

CHANGE GENERAL COMMERCIAL ZONE (C1) TO INCLUDE ONE OR MORE RESIDENTIAL DWELLING UNITS ON UPPER LEVELS OF BUILDINGS

TAKE NOTICE that on the 18th day of March 2025, The Corporation of the Municipality of Wawa adopted By-Law No. 3782-25 under Section 34 of the Ontario Planning Act to amend Section 4.4 of Wawa Zoning By-law No. 2821-15 by adding that buildings in the General Commercial (C1) Zone may have one or more residential dwelling unit(s) in a building on any upper level.

THE PURPOSE AND EFFECT of the Zoning By-law Amendment is to amend Wawa Zoning By-law 2821-15 to permit commercial buildings in the General Commercial (C1) Zone to have one or more dwelling units in upper levels.

TAKE NOTICE that appeals to the Ontario Land Tribunal in respect of the By-Laws may be made by filing a written notice of appeal with the Clerk of the Municipality of Wawa, no later than the 8th day of April 2025, setting out the reasons for the appeal and accompanied by the Ontario Land Tribunal Appellant Form (A1) and required fee made payable to the Minister of Finance. This form is available on-line at https://olt.gov.on.ca/.

IF A PERSON or public body did not make oral or written submissions to the Municipality of Wawa before the By-Law was passed, the person or public body is not entitled to appeal to the Ontario Land Tribunal. Only individuals, corporations, and public bodies may appeal the By-Law to the Local Planning Appeal Tribunal. A Notice of Appeal may not be filed by an unincorporated association or group. A Notice of Appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the By-Law was passed, the person or public body made oral submissions at a Public Meeting or written submissions or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

NO PERSON or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
