NOTICE OF PASSING OF BY-LAW NO. 3712-24
TEMPORARY ZONING BY-LAW AMENDMENT
Pursuant to Section 34 of the Planning Act, R.S.O. 1990
Take Notice that Council of The Corporation of the Municipality of Wawa passed By-Law No. 3712-24 on the 7th day of May 2024 amending Wawa Zoning By-Law No. 2821-15, by adding a temporary zone designation on land described as Mining Claims MC SSM 3455, Pcl 5136 AWS and SSM 59662, Pcl 1148 MICH in the Geographic Township of McMurray in the Municipality of Wawa in the District of Algoma.
And Take Notice that any person or public body may appeal to the Ontario Land Tribunal in respect of the Zoning By-Law 3712-24 by filing with the Clerk of the Municipality not later than June 3, 2024, a Notice of Appeal setting out the reasons in support of the appeal, accompanied by the fee prescribed by the Ontario Land Tribunal made payable to the Minister of Finance. A copy of the appeal form is available on the Local Tribunal Appeal Board website and the appeal may be dismissed by the Ontario Land Tribunal if the fee is not paid.
The Purpose and Effect of the Zoning Amendment is to permit temporary camp accommodations on the Red Pine mining claims located on Surluga Road for a period of up to 36 months, or until May 8, 2027 (key map below).
If a person or public body did not make an oral or written submission to the Municipality of Wawa on this application prior to Council by-law approval, the person or public body may not appeal a decision of the Municipality to the Ontario Land Tribunal Appeal Board. Only individuals, corporations and public bodies may appeal the Council decision to the Ontario Land Tribunal. A notice of appeal may not be made by an unincorporated association or group; however, a notice of appeal may be made in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of an appeal unless the person or public body made oral submissions at a public meeting or written submissions were made to the Municipality of Wawa before the application was considered by Municipal Council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
